Arrest Judge Maria Stella Jara

and her Accomplices

On November 6, 1985, terrorists from the M-19 group, funded by drug trafficker Pablo Escobar, invaded the Palace of Justice in Bogotá, shot and killed dozens of people, set fire to the archives, and staged a trial, demanding the presence of then-President Belisario Betancur, whom they would  “judge.”

Summoned by the President, Colombian army troops knocked down the doors of the building with tanks, killed some terrorists, imprisoned some others, and freed 240 hostages—all this happened at the same time that 90 other hostages were dying in the flames and in the crossfire, and the building was being reduced to a pile of rubble and bodies.

Four years later, the surviving terrorists were granted amnesty, and with the aid of their agents and supporters infiltrated in the Colombian justice system, launched a legal assault against the authorities, by accusing them of several crimes and attempting to destroy those who had not been vanquished by criminal violence through a character-assassination campaign.

They achieved some isolated successes through this effort, but their most shocking victory came on June 14, 2010, when Col. Luis Alfonso Plazas Vega, commander of the troops that drove the invaders from the Palace of Justice, was sentenced by Judge Maria Stella Jara to thirty years in prison, after being found guilty of the forced disappearance of eleven people, including terrorists and Palace staff members, who, according to the indictment, would have been removed from the Palace building, taken to the Army Cavalry School, and then murdered.

Immediately after signing the sentence, Judge Jara fled to Germany, claiming she had been receiving death threats, of which she never presented the slightest evidence. Indeed, she had far more serious reasons to flee the country. In prostituting the judiciary in order to use it as an instrument for political revenge, Judge Jara committed a heinous, cold, and premeditated crime, and she knows that if she had stayed in Colombia, sooner or later, she would have been the one sent to jail instead of Colonel Plazas.

Not only did the judge condemn an innocent, but she also sentenced him for a crime that never took place. Colonel Plazas, however, was not a victim of a simple miscarriage of justice.Judge Stella Jara knows exactly what she did. The eleven “disappeared” who are allegedly missing in the final report on the victims found in the Palace of Justice have never actually disappeared. The mortal remains of several of them are stored in a forensic laboratory atUniversidad Nacional (National University) in Bogotá (an institution full of people who support the M-19).

On February 24, 2010, Bogotá’s Caracol Radio Station reported that four of the eleven people had been already identified. Until the end of the lawsuit, Judge Maria Stella obstinately prevented the defense attorneys from having access to the report of the autopsy. Of the remaining “disappeared,” one (a woman) was returned by the University to her family, but the judge never accepted to at least diminish the official number of “disappearances” from eleven to ten. Another one died in 1986, a year after the military action, and was buried at Cementerio del Sur (South Cemetery) in Bogotá, but the testimony of the gravedigger who buried her was ignored by the judge. The Colombian Army repeatedly indicated the place where three others are buried, but the judge never allowed their bodies to be exhumed. One of the girls who could be seen in the photos of the rescue was also listed as “disappeared,” but soon afterwards a lady appeared on TV stating that the person in those images was no one else but herself. The judge, to intimidate her, requested that she should be investigated for “false testimony,” changing the subject when nothing could be proved against the honesty of the lady’s statement. Now, if we redo the calculations taking all these facts into account, how many of the “disappeared” are left? One. And the judge never allowed anyone to verify whether this person is or is not one of those in the forensic laboratory of the National University. The Colonel was convicted for a crime that never happened.

To give the impression that a crime did happen, the judge, in addition to blocking access to evidence, made use of several shamelessly false testimonies. The chief witness who claimed to have seen the transfer of the “disappeared” to the Cavalry School is former Army Corporal Tirso Saenz, who said he had participated in the military recapture of the Palace, but it has been found out that he could never have been there because at that time he was in jail— and here is the height of irony—for false testimony! Later he himself denied his statement, but the judge did not budge at all: in order to condemn Colonel Plazas, any lie is good enough, even if it is a lie contested by its own author.

A second crucial testimony was that of Edgar Villamizar, who, being in another city at the time, could not possibly have seen anything at the Cavalry School. He claimed to have been transported in a rush to the School by a helicopter, but, back in 1985, the Colombian Army had no helicopters at all. This man flew thanks to the powers of his mind.

Third testimony: Auxiliary Police Officer Ricardo Gámez claimed that he had participated in the rescue operation, during which he had supposedly heard Colonel Plazas order his men to kidnap eleven people. But he could not possibly have participated in any such operation, since he had deserted from the police in 1979.

It is most evident that the condemnation of Colonel Plazas is the result of a trap set up by his accusers with the manifest connivance of Judge Maria Stella Jara. Among these stand out, for its vengeful viciousness and compulsive lying, the “Colectivo de Abogados José Alvear Restrepo” (a million-dollar lawyers’ collective that defends the Colombian narco-guerrillas), and Prosecutor Angela Maria Buitrago, who has been recently removed from office forincompetence. Voluntary incompetence, it must be made clear, since the said lady put hundreds of lawsuits on the back burner in order to devote all her working hours to the fulfillment of her ultimate dream: the destruction of Colonel Plazas.

In view of these facts, we the undersigned call on the Colombian authorities to initiate an investigation to determine and punish the criminal conduct of Judge Maria Stella Jara, Prosecutor Angela Maria Buitrago and the José Alvear Restrepo Lawyers’ Collective in this perverse lawsuit. More than the freedom of an innocent, what is at stake is the honor of the Colombian justice system.

Como Sargento Mayor retirado del ejercito.,.,.,tuve la oportunidad de conocer a mi Coronel Plazas y de trabajar en La Escuela de Caballeria durante nueve años, cuando ocurrio la toma violenta del palacio de justicia me encontraba en el SINAI como integrante de la comisión de paz del batallon colombia Nº 3; como colombiano y como subalterno que fui de mi Coronel Plazas quiero brindarle a él y a su familia mi apoyo como lo deberia de hacer todo el pueblo colombiano que sufrió los horrores de la guerra librada por el grupo narcoterrorista del M-19, he insentivar a los colombianos a repudiar a los verdaderos autores de los crimenes cometidos en el palacio de justicia, cada uno de los lideres y milicianos q conformaron esta guerrilla, por que mientras mi Coronel paga una condena injusta.,.,.algunos de los pertenecientes al desaparecido M 19 se sentaban muy comodos en las sillas del congreso a hablar con sinismo de JUSTICIA cuando deberian ser ellos los q deberian de estar en la carcel pagando por la muerte de los inocentes que enpañaron de sangre los pacillos del palacio de justicia.
